Contract Law in Dallas

Basically, contracts are promises between two or more parties that are legally enforceable. There are legal remedies if a contract is broken. For a promise to be legally binding as a contract, there must be a benefit or detriment which a party receives which reasonably and fairly induces them to make the promise or contract. Occasionally promises that are not considered contracts may be enforced if one party has relied to their detriment on the assurances of the other party.

Contracts are mainly governed by state statutory, common law and private law. Private law includes the terms of the agreement between the parties who are exchanging promises. Private law may override many of the rules otherwise established by state law. Statutory law may require some contracts be in writing and executed in a certain manner. Otherwise, the parties may enter into a binding contract without a formal written agreement.
